Effective date: September 30, 2026  |  Last updated: September 30, 2026

1. Who we are and scope

Smart Pro Technologies LLC ("Smart Pro Technologies," "we," "us," or "our") is a Texas limited liability company located at 2641 Franklin Dr, Mesquite, TX 75150, United States. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit https://smartpros.tech (the "Site"), contact us, or engage our AI development and consulting services (together, the "Services").

This Policy does not cover information we process on behalf of our business clients under a services agreement. In those cases we act as a service provider or processor, and the client's own privacy notice governs that information. If you are a client's customer or employee, please direct privacy questions to that client.

2. Information we collect

Information you provide to us

  • Contact and inquiry information: name, email address, phone number, company name, job title, and the contents of messages you send through our contact form, email, or phone.
  • Business relationship information: billing details, contract information, project requirements, and communications exchanged during an engagement.
  • Recruiting information: résumés and related details if you apply to work with us.

Information collected automatically

  • Technical data: IP address, browser type and version, device type, operating system, referring URL, pages viewed, and access times. Our web hosting provider may record this information in standard server logs for security and reliability purposes.
  • Preferences: a small value stored in your browser's local storage to remember that you have seen our cookie notice. See our Cookie Policy.

We do not currently use third-party analytics, advertising, or social-media tracking technologies on the Site. If that changes, we will update this Policy and our Cookie Policy before doing so.

Information from other sources

We may receive business contact information from referral partners, publicly available professional profiles, or business directories when researching prospective clients.

3. How we use information

We use personal information to:

  • Respond to inquiries and provide requested information, proposals, and quotes;
  • Deliver, manage, and improve our Services and fulfill our contracts;
  • Communicate with you about projects, invoices, and service updates;
  • Send occasional marketing communications about our Services where permitted by law (you can opt out at any time);
  • Operate, secure, and troubleshoot the Site;
  • Comply with legal obligations, enforce our agreements, and protect our rights, property, and safety and those of others.

We do not sell personal information, and we do not use personal information collected through the Site to train artificial intelligence models.

4. Personal information and our AI services

Our work often involves building AI systems that process data supplied by clients. When we do so:

  • We process client data only as instructed by the client and as described in the applicable services agreement;
  • We use reputable third-party AI model providers and cloud platforms as sub-processors where a project requires them, subject to their contractual data-protection commitments;
  • We do not use client data to train models for other clients or for our own general purposes without explicit written authorization;
  • We recommend data minimization, access controls, and, where appropriate, de-identification before data is used in AI workflows.

5. How we share information

We share personal information only in the following circumstances:

  • Service providers: companies that provide hosting, email, cloud infrastructure, payment processing, scheduling, document signing, and similar services on our behalf, under confidentiality obligations.
  • Professional advisors: lawyers, accountants, and insurers where necessary.
  • Legal requirements: when required by law, subpoena, or governmental request, or to protect our rights or the safety of any person.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business, subject to this Policy.
  • With your consent or at your direction.

We do not sell personal information or share it with third parties for cross-context behavioral advertising.

6. Data retention

We keep personal information only as long as needed for the purposes described above. Inquiry records are generally retained for up to 24 months after our last contact unless a business relationship follows. Contract, billing, and tax records are retained for the period required by applicable law (typically seven years). Server logs are kept for a limited period by our hosting provider for security purposes. When information is no longer needed, we delete or de-identify it.

7. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encrypted connections (HTTPS), access controls, and vendor due diligence. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and the relevant authorities as required by applicable law, including the Texas Identity Theft Enforcement and Protection Act.

8. Your privacy rights and choices

Depending on where you live, you may have rights to:

  • Know what personal information we hold about you and receive a copy of it;
  • Correct inaccurate personal information;
  • Delete personal information, subject to legal exceptions;
  • Opt out of the sale or sharing of personal information and of targeted advertising (we do not engage in these activities);
  • Withdraw consent where processing is based on consent;
  • Not be discriminated against for exercising your rights.

To exercise any right, email tasha@smartpros.tech with the subject line "Privacy Request," or write to the address in Section 12. We may need to verify your identity before responding, and we will respond within the time required by applicable law (generally 45 days). You may designate an authorized agent to make a request on your behalf; we may ask for proof of that authorization. If we deny your request, you may appeal by replying to our decision email with the word "Appeal."

Texas residents

The Texas Data Privacy and Security Act (TDPSA) grants Texas residents the rights listed above where applicable. We do not sell personal data or process it for targeted advertising or profiling with legal or similarly significant effects.

California residents

The California Consumer Privacy Act, as amended by the CPRA, grants California residents the rights to know, delete, correct, and opt out described above. In the preceding 12 months we have collected the categories of personal information described in Section 2 (identifiers, commercial information, internet activity, and professional information) for the purposes described in Section 3, and disclosed them to the categories of recipients listed in Section 5 for business purposes only. We do not "sell" or "share" personal information as those terms are defined under California law, and we have no actual knowledge of selling or sharing personal information of consumers under 16. This section serves as our "Do Not Sell or Share My Personal Information" notice.

Other U.S. states

Residents of Virginia, Colorado, Connecticut, Utah, Oregon, Montana, and other states with comprehensive privacy laws may exercise the rights available to them under those laws by contacting us as described above.

Visitors outside the United States

We are located in the United States and process information here. If you contact us from the European Economic Area, United Kingdom, or another jurisdiction with data-protection laws, our legal bases for processing are performance of a contract, our legitimate interests in operating and promoting our business, compliance with law, and your consent where required. You may have the right to lodge a complaint with your local supervisory authority.

You may unsubscribe from marketing emails at any time by using the link in the email or contacting us. We will continue to send transactional messages related to any active engagement.

9. Children's privacy

Our Site and Services are intended for businesses and adults. We do not knowingly collect personal information from children under 13 (or under 16 where a higher age applies). If you believe a child has provided us with personal information, please contact us and we will delete it.

10. Third-party links

The Site may contain links to third-party websites and services (for example, Google Maps or scheduling tools). We are not responsible for the privacy practices of those third parties. We encourage you to read their privacy notices.

11. Changes to this Policy

We may update this Policy from time to time. The "Last updated" date at the top indicates when it was most recently revised.
